Atlanta, GA (October 30, 2024) – The GBI is investigating an officer-involved shooting in Atlanta, Georgia. The Atlanta Police Department asked the GBI to conduct an independent investigation on October 29, 2024. One man was shot and sustained non-life-threatening injuries. One officer was injured in this incident. 

The preliminary information indicates that, at approximately 10:12 A.M., the Atlanta Police Department responded to a report of a subject pointing a gun at an employee at the Four Seasons Hotel. The residential manager was contacted by a resident who advised a subject had thrown items into the hallway on the 33rd floor. The manager went to the floor and was immediately confronted by a resident of the building, identified as Jay Berger, 70, who pointed a firearm at him. The manager returned to the ground floor and called the police. Upon officers arriving, Berger barricaded himself inside his apartment. SWAT was requested and responded to the scene. The subject began firing a weapon inside his apartment and into the hallway. As rounds were fired through the walls at SWAT officers, one officer returned fire. One SWAT officer was injured during the incident (possibly by shrapnel). The subject then proceeded onto the balcony of his apartment and began throwing items off the balcony. At some point during the encounter, a SWAT sniper fired at the subject and struck him. SWAT entered the subject’s apartment and took the subject into custody without further incident.

Berger was transported to an area hospital for treatment and will be taken to the Fulton County jail upon release from the hospital. Once complete, the GBI case file will be turned over to the Fulton County District Attorney’s Office for review.
