Atlanta, GA (April 24, 2023) –  The GBI is investigating an officer involved shooting in Atlanta, GA. The Atlanta Police Department (APD) asked the GBI to conduct an independent investigation on April 23, 2023. One man was shot and is in stable condition. No officers were injured during the incident.

The preliminary information indicates that on April 23, 2023, shortly before 4:50 a.m., security guards at the Greyhound bus station on Forsyth Street were attempting to escort a disorderly man outside the station but he would not cooperate. At that time, security guards asked two uniformed APD officers at the scene for help. The officers were able to move the man, identified as Tobias Levontae Sutton, age 30, of College Park, outside and were escorting him toward the sidewalk. During the encounter, Sutton pulled a handgun from a suitcase he was pushing and shot at the officers. One of the officers returned fire and shot Sutton. Aid was rendered and Sutton was taken to an area hospital where he is listed in stable condition.

The GBI will conduct an independent investigation. Once complete, the case file will be given to the Fulton County District Attorney’s Office for review.
